By downloading, installing, or using the NomoFit application ("App"), you agree to be bound by these Terms of Service and End User License Agreement ("Agreement"). If you do not agree to these terms, do not use the App.
This Agreement is between you ("User" or "you") and Nomofit ("Company," "we," "us," or "our"), an Australian company. This Agreement governs your use of the NomoFit mobile application and related services (collectively, the "Service").
Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a mobile device that you own or control, solely for your personal, non-commercial use.

To access certain features of the App, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
NomoFit offers a free tier that includes limited features, including up to 3 AI-generated workouts per week, access to the ready-to-go workout library, and basic tracking features.
NomoFit Pro is available as a paid subscription that unlocks additional features including unlimited AI workouts, full weekly structure plans, advanced progress insights, and premium content.
Subscriptions are billed through the Apple App Store or Google Play Store. Payment will be charged to your App Store or Google Play account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
You may cancel your subscription at any time through your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period. No refunds will be provided for partial billing periods.
You retain ownership of any content you create, submit, or display through the App ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content solely for the purpose of operating and providing the Service.
You represent and warrant that you have all rights necessary to grant these licenses and that your User Content does not violate any third-party rights or applicable laws.
NomoFit is not a medical application. The workouts, exercise routines, and fitness information provided through the App are for informational and educational purposes only. They are not intended to be a substitute for professional medical advice, diagnosis, or treatment.
You should consult your physician or other qualified health provider before starting any new exercise program, particularly if you have any pre-existing health conditions, injuries, or concerns. You use the App and perform any exercises at your own risk.
We are not responsible for any injuries, health issues, or damages that may result from using the App or following any workout routines provided through the Service.
NomoFit uses artificial intelligence to generate personalized workout routines. While we strive to provide safe and effective workout recommendations, AI-generated content may not be suitable for everyone. Always use your own judgment when performing exercises and stop immediately if you feel pain or discomfort.
The App, including all content, features, and functionality (including but not limited to text, graphics, logos, icons, images, audio, video, software, and the design, selection, and arrangement thereof), is owned by Nomofit and is protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using the App, you agree to our Privacy Policy.
We may terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including if you breach this Agreement. Upon termination, your right to use the App will immediately cease. All provisions of this Agreement that by their nature should survive termination shall survive.
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL NOMOFIT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THIS AGREEMENT SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless Nomofit and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the App, your User Content, or your violation of this Agreement.
This Agreement shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of laws provisions. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Australia.
We reserve the right to modify this Agreement at any time. We will notify you of any material changes by posting the updated Agreement within the App or on our website. Your continued use of the App after any such changes constitutes your acceptance of the revised Agreement.
If you downloaded the App from the Apple App Store, the following additional terms apply:
If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
This Agreement, together with the Privacy Policy, constitutes the entire agreement between you and Nomofit regarding the use of the App and supersedes all prior agreements and understandings.
